How much legal costs that you can get if you win in the Court?

Recently, there is an amendment via PU(A) 265/2025 of the Rules of Court 2012

There are three parts to this:

  1. Interlocutory application:
  • Magistrate court – RM2,500 – RM15,000.00;
  • Sessions court – RM3,000 – RM40,000.00;
  • High court – discretion of court
  1. Judgment in Default of Appearance (“JID”)

JID is when a judgment is obtained without full trial or without the opponent entering appearance in the court, resulting in the plaintiff obtaining a judgment.

Basic cost

  • If defendant pays the sum after suit filed – RM3,000 (HC), RM2,000 (SC), RM1,000 (MC);
  • JID – RM5,000 (HC), RM3,000 (SC), RM3,000 (MC);

Cost for additional items

  • Court actual fees incurred
  • Affirmation fee actual incurred
  • Each attempted service
  • Title searches – actual fees incurred
  1. Full Trials

O59, r23 – it is a combination of legal fees of suing/defending fee and also advocacy fee. If claim sum above RM500,000, legal fee can be between RM20,000 and RM500,000.
